Abstract

This study addressed intrauterine adoption as a legal alternative to safeguard the life of the unborn child, comparing Ecuador and Chile. The objective was to determine how this legal concept contributed to the protection of the unborn child without the biological mother feeling coerced into giving up her child. A qualitative approach with a critical paradigm was applied, based on analytical-synthetic, dialectical, and legal hermeneutic methods, through a documentary review of constitutional norms, laws, doctrine, and scientific studies. The results showed that in Chile, prenatal adoption is regulated and guarantees the rights of the unborn child, reduces the risk of abortion, and strengthens the family institution, while in Ecuador there is no specific regulation despite constitutional recognition of life from conception. It was concluded that intrauterine adoption represented a viable mechanism for protecting the life and rights of unborn children.
