Abstract

The prison crisis in Ecuador was characterized by violent clashes, overcrowding, and a lack of effective rehabilitation policies, which seriously affected the rights of persons deprived of liberty. The objective of this study was to analyze the social rehabilitation system and the state's guarantee of the constitutional rights of this population during the period 2021-2022. A mixed methodology was applied, combining a quantitative approach based on surveys of inmates in four prisons with a qualitative analysis of doctrinal and regulatory sources. The results revealed deficiencies in integrity, quality of life, health, safety, infrastructure, and reintegration programs, as well as poor state compliance with its responsibilities as guarantor. It was concluded that the prison system did not fulfill its purpose of rehabilitation and that immediate and comprehensive intervention was required, articulating social, prison, and security measures to ensure effective reintegration.
