Notarial mediation, within civil and registry law, is emerging as a promising alternative mechanism for conflict resolution. That is why this study aims to analyze notarial mediation as an alternative mechanism for conflict resolution in Ecuador, based on its viability and effectiveness in relieving congestion in the judicial system and offering more agile solutions to disputes. The research employs a qualitative approach based on grounded theory, using techniques of literature review, exegetical analysis, and synthetic analysis of legal regulations. The implementation of mediation in Ecuador could have several key benefits, such as reducing the burden on the courts, promoting an environment of cooperation between the parties in conflict, and preserving personal and commercial relationships. This study contributes to the debate on the expansion of notarial powers and their potential positive impact on the Ecuadorian justice system.
