Abstract

This study provides an in-depth analysis of the technical and legal issues that arise in the notarial field with the incorporation of telematic means in the execution of deeds and contracts. Its main objective is to demonstrate that their use is compatible with the guiding principle of immediacy, guaranteeing the rights of the parties involved. Using a methodology that includes analysis of current regulations, specialized doctrine, success stories in countries such as Spain and Argentina, and interviews with experts, this research seeks to provide solutions for Ecuadorian notarial law. The study concludes that it is possible to adapt technological tools to offer an efficient telematic notarial service without losing the solemn nature of public faith, an essential function of the notary as a representative of the State.
