The role of the notary in Ecuador is essential to guarantee the legal security of the real estate market. As public officials, they ensure the authenticity and legality of real estate transfers, verifying the capacity of the parties and that the properties are free of liens and encumbrances. This research seeks to analyze the relationship between the lack of clarity in notarial functions and the correct registration of properties in the Property Registry, which is key to improving real estate transactions and legal certainty. In addition, it examines how recent regulatory reforms have promoted the modernization and digitization of the notarial system, increasing efficiency and transparency in the management of these transactions. Using a qualitative approach, it identifies areas for improvement in notarial functions to strengthen public confidence and consolidate legal certainty in real estate transactions.
