Abstract

This scientific article provides a critical analysis of the provision of telematic notarial services in Ecuador, highlighting the absence of adequate regulation and due respect for the legal nature of the notary. The objective was to establish basic guidelines for regulations in accordance with the principles governing the Latin notarial system. From a qualitative and comparative approach, doctrinal and jurisprudential documents were analyzed to understand the fundamentals of the notarial function and its relationship with information and communication technologies (ICT). There is a clear need for profound reforms in policies and the legal system in order to harmonize the notarial function with the new technological reality, without neglecting the principles of public trust and legal certainty. Finally, perspectives and challenges that point toward the efficient and legitimate provision of telematic notarial services are examined.
