Abstract

The objective is to elaborate a critical-legal analysis of the Personal Data Protection Law in Ecuador in the customer collection system of the parish of Guamaní, Quito, from January to June 2023, to contribute to the respect of the Constitutional Rights of debtors. Theoretical and empirical research methods have been applied for the purpose of collecting and analyzing information relevant to the subject of the study. As a result of the semi-structured interview with intentionally selected individuals, it was evident that, in certain circumstances, their constitutional rights as debtors had been violated. Therefore, a critical legal analysis of the constitutional rights of debtors was carried out with the aim of disseminating knowledge about them. It was concluded that, under the current circumstances, it is the duty of all individuals to comply with constitutional rights.
