Abstract

This article analyzes the obligation to update cadastral data, such as that relating to surface areas, boundaries, and dimensions, in transfers of ownership involving dismemberments, as an essential guarantee of property rights and to prevent harm to third parties. It argues that this measure is fundamental to maintaining the integrity and accuracy of the registry, strengthening legal certainty, and preventing future disputes. The study explores the legal basis of property ownership and examines the powers, competences, and responsibilities of the Registrar to ensure the legality of registrations. It concludes that it is necessary to establish clear regulations that allow for the refusal of registration of documents that do not comply with legal requirements, thus preserving the legality and reliability of the registry system as a pillar of economic and social development.
