Abstract

AMAN-VILLEGAS, Bryan Omar; INFANTE-MIRANDA, María Elena  and  MONTECE-GILER, Salomón Alejandro. Constitutional right to free development of personality in an educational institution in Pelileo, Ecuador. Noesis [online]. 2025, vol.7, n.esp1, pp.1945-1963.  Epub Nov 30, 2025. ISSN 2739-0365.  https://doi.org/10.35381/noesisin.v7i1.568.

The violation of the constitutional right to free development of personality, recognized in Article 66, paragraph 5 of the Constitution of the Republic of Ecuador, was analyzed with the aim of identifying the causes affecting it in the “Domingo Faustino Sarmiento” Educational Unit in the Pelileo canton during the period September 2022 - June 2023. Theoretical methods such as analytical-synthetic, inductive-deductive, and historical-logical were used, along with empirical techniques to collect and examine information. The results, obtained through semi-structured interviews with key informants, reflected the perceptions of the educational community and constitutional law professionals. It was evident that factors such as physical appearance and economic status violate this right, so it is recommended that rights education content be included in the curriculum and that talks aimed at teachers and students be promoted. It is concluded that guaranteeing this right is essential for human dignity and the comprehensive development of students.
