Abstract

This research developed a legal analysis of the violation of the right to equality enshrined internationally and in the Ecuadorian Constitution as a result of the application of the summary procedure provided for in the Comprehensive Organic Criminal Code in the canton of Santo Domingo in 2021. This study is framed within a mixed methodology, under an interpretive paradigm, with a descriptive scope. From the point of view of sources, it is documentary on the one hand, and on the other hand, it also made use of a survey through a questionnaire to achieve the expected results. Analytical-synthetic, comparative, logical and critical, and inductive-deductive methods were used. The research concluded that in the canton of Santo Domingo in Ecuador, when defendants avail themselves of summary proceedings, their right to equality is violated.
