This paper focused on the effectiveness of the habeas data action for the rectification and deletion of data during the year 2021 within the Judicial System of the Canton of Santo Domingo. This action, recognized as a constitutional guarantee, allows for modifications and corrections of personal documents through the remedy established in the Constitution. The objective of the article was to examine habeas data as an appropriate jurisdictional mechanism. A total of 100 practicing attorneys in the area participated by answering questions about the effectiveness of habeas data. Of those, 70% did not consider it effective, while 30% did view the action as effective. Additionally, data related to habeas data cases in 2021 in Santo Domingo was reviewed. The results conclude that, although its use is limited, it constitutes an effective remedy to guarantee fundamental rights.
