Abstract
GAIBOR-CASTILLO, Jessenia Verónica; CHACON-GOMEZ, Nayibe Eloina and CASTRO-SANCHEZ, Fernando de Jesús. Notarial errors in Ecuador: comparative analysis and repercussions on users' rights. Noesis [online]. 2025, vol.7, n.esp2, pp.36-48. Epub Dec 31, 2025. ISSN 2739-0365. https://doi.org/10.35381/noesisin.v7i2.476.
This study analyzed the management of notarial errors in Ecuador and compared it with other international systems, based on the importance of legal certainty and trust in legal transactions. The objective was to identify how administrative errors influence users' rights and determine best comparative practices. A qualitative approach was applied, based on documentary analysis and comparative legal study, reviewing regulations, reports, and international experiences. The results showed that the implementation of internal control mechanisms, continuous staff training, and the adoption of digital technologies were key to reducing errors and strengthening transparency. The comparison showed that countries such as Indonesia have clearer frameworks for accountability and sanctions. In conclusion, the need to strengthen digitization, professional ethics, and citizen education was highlighted to ensure efficiency, trust, and protection of rights in the notarial system.
