Abstract

Refusals of registration issued by the registry constitute a mechanism by which the Property Registrar determines the inadmissibility of acts and contracts, indicating precisely the reasons for their rejection. In this situation, those affected may appeal to the competent judge, who, after thoroughly analyzing the documentation, issues a ruling for immediate compliance; if registration is denied, an appeal may be lodged with the Superior Court. This research focuses on property registrars and refusals of inadmissible acts and contracts in Ecuador, approaching the subject from a qualitative perspective through critical documentary analysis of doctrine, case law, and current regulations. It is evident that, despite its social and legal relevance, the registration law does not fully comply with social, technological, and regulatory advances, creating gaps in legal certainty and the effectiveness of registration qualification.
