Resumen

LEON-LEITON, Samantha Elizabeth; CHACON-GOMEZ, Nayibe Eloína  y  ALFONSO-GONZALEZ, Iruma. Legal and family consequences of equal marriage in Ecuadorian notary offices. Noesis [online]. 2025, vol.7, n.esp2, pp.196-214.  Epub 31-Dic-2025. ISSN 2739-0365.  https://doi.org/10.35381/noesisin.v7i2.531.

Although marriage equality has made significant progress, it still faces barriers in terms of notarization and registration, which prevent it from being completely equal to heterosexual marriage. Its legalization is an important step, but it is insufficient without comprehensive regulatory reform to eliminate persistent inequalities. Combined with political will and media coverage, the implementation of constitutional reform is essential to advance toward real equality. Despite the positive contribution of notaries in formalizing de facto unions, their limited capacity to perform marriages shows restrictions that still prevent full equality. This study examines the legal and family consequences of marriage equality, with the aim of adapting regulations and ensuring that the legal framework reflects the constitutional principles of equality. To this end, qualitative methods were used, such as the analysis of doctrinal and jurisprudential documents, comparative law, and a descriptive approach to characterize the legal institution in question.

Palabras clave : Equal marriage; legal and family consequences; notarial and registration law..
