With the aim of identifying the main causes of ignorance of bare ownership, this research developed a study of doctrine, jurisprudence, and national regulations regarding the extinction of usufruct due to death in Ecuador. Qualitative nature, the research collected and analyzed data and documents that allowed for a description of the legal institution. It analyzed how judges and notaries make appropriate use of the legal system for an effective understanding of the law. The study took on a national and international dimension in cases such as Argentina, Chile, Spain, and Peru, on the right to ownership of the bare owner upon the extinction of usufruct due to death, which determined causes and patterns of legal practice with respect to the subject under investigation.
