Abstract

MERINO-NARVAEZ, María Isabel; ALFONSO-GONZALEZ, Iruma  and  CASTRO-SANCHEZ, Fernando de Jesús. Legal consequences of notarial acts or contracts entered into by people with intellectual disabilities. Noesis [online]. 2025, vol.7, n.esp2, pp.373-395.  Epub Dec 31, 2025. ISSN 2739-0365.  https://doi.org/10.35381/noesisin.v7i2.594.

This article analyzes Resolution 011-CONADIS-2018 in Ecuador, aimed at strengthening the legal capacity of persons with intellectual disabilities in the notarial sphere. Using a qualitative and legal dogmatic methodology, normative documents, doctrine, and specialized literature are examined to evaluate the impact of this resolution on notarial practice. It finds that, although the Resolution represents a step forward in terms of inclusion and recognition of rights, its implementation faces obstacles such as a lack of awareness of the regulations among legal practitioners and a failure to adapt notarial procedures. The study concludes that it is necessary to promote professional awareness and reform legal practices to ensure the autonomy and full participation of this group. It is recommended that further research be conducted to gather the direct experiences of people with intellectual disabilities in order to improve regulatory implementation and move toward a more equitable and inclusive society.
