Abstract

The research analyzes the granting of protective measures and their impact on the constitutional protection of victims and perpetrators in cases of domestic violence in the Babahoyo canton during 2021. The objective was to guarantee effective protection of the fundamental rights of victims through agile and expeditious judicial mechanisms. The methodology was mixed, with a qualitative-quantitative approach and descriptive scope. At the theoretical level, analytical-synthetic and inductive-deductive methods were applied, while at the empirical level, documentary analysis and surveys were used. The survey was applied to a non-probabilistic sample of lawyers in private practice, members of the Los Ríos Bar Association, who filed protection actions in cases of domestic violence against women. The results reflect the need to consolidate immediate judicial procedures, guaranteeing due process, constitutional protection, and the safety of victims.
