Abstract

MAYANQUER, Cruz Grace Galárraga; MIRANDA, María Elena Infante  and  GILER, Salomón Alejandro Montecé. Limitation on the constitutional right of citizen participation to serve as a judge on the constitutional court. Noesis [online]. 2025, vol.7, n.esp2, pp.552-569.  Epub Dec 31, 2025. The research analyzes compliance with the right to citizen participation in the process for the selection and appointment of judges of the Constitutional Court, evidencing its violation. The objective was to analyze the feasibility of a reform proposal on the appointment and election of judges of the Constitutional Court of Ecuador. Methods have been applied at the theoretical level of knowledge such as the analytical-synthetic and the inductive-deductive, at the empirical level the documentary analysis and the technique of the Interview. The results obtained indicate a lack of transparency in the merit assessment phase. Consequently, it is concluded that a reform of Articles 18, 19 and 21 of the Mandate for the Appointment of Members of the Constitutional Court of 2018 is necessary, including a final paragraph in them where it is established that this phase must be carried out in front of a notary.
