Abstract

This study examines the restitution of the marital estate as a notarial power within Ecuadorian law, focusing on patrimonial effects when administration rests with the spouses. It analyzes notaries’ authority to dissolve the marital estate either together with divorce or independently while the marital bond remains. The objective is to analyze the power of notaries to dissolve the conjugal partnership simultaneously with divorce or independently without extinguishing the marriage bond. It uses a mixed methodology combining quantitative and qualitative data with a philosophical-legal analysis of notarial principles. As a result, the study evaluates the advisability of reestablishing legal foundations that protect family members economically and socio culturally and proposes legal instruments to provide legal certainty, effectiveness, and efficiency to notarial public services in Ecuador.
