Abstract

The research analyzes the scope of the right to personal data protection in the Ecuadorian notarial function, highlighting its constitutional recognition as a fundamental right. Under the principle of publicity and Article 40 of the Notarial Law, anyone can request copies of public deeds without the consent of the owner or justification for use, which violates personal and family privacy and intimacy. There is a clear lack of specific obligations for notaries regarding the processing of personal data. The study proposes harmonizing the Notarial Law with the Organic Law on Personal Data Protection and constitutional principles in order to guarantee the effective protection of this right. The research is structured around data protection, the granting of copies and certified copies, and the violation of rights in notarial offices.
