Abstract

The objective of the research is to conduct a critical analysis of the relationship between the storage of Suspicious Transaction Reports (STRs) by the Financial and Economic Analysis Unit (UAFE) and the possible violation of the right to the presumption of innocence, considering that a person is only declared guilty by a final judgment and is previously considered a suspect. To obtain reliable information, a mixed approach of methods and techniques was used. Interviews and surveys were used to gather information on the subject. The legal analysis of the unconstitutionality of ruling 18-18-IN of the Constitutional Court of Ecuador indicates that neither the presumption of innocence nor the right to the protection of personal data stored for ten years is violated, due to the regulations that punish the improper disclosure of information.
