Abstract

This study conducts a critical legal analysis of the protection of credit-related personal data within Ecuador's financial system and its potential tension with financial institutions' right to manage their risk profile. Using a qualitative methodology and a documentary analysis of current regulations, the research examines the strict measures institutions must comply with, such as obtaining data subject authorization. It identifies that the lack of credit history complicates risk assessment, forcing entities to develop more rigorous internal processes. It concludes that, while the current regulatory framework is effective for data protection, challenges persist, particularly in disseminating these rights to customers.
