Abstract

This study analyzes notarial and registry discrepancies in Ecuador, highlighting the urgent need for effective solutions. Using a qualitative approach, philosophical-legal and socio-legal methods were applied, with analytical and empirical techniques. Two notaries and two registrars from Chimborazo were interviewed. The results reveal that discrepancies arise from divergent regulatory interpretations, administrative errors, lack of legal updates, and absence of integrated technology, affecting legal certainty and public confidence. Measures such as joint training, technological platforms, and technical roundtables are proposed to unify criteria. The reforms include regulatory clarification, the creation of an arbitration body, and continuing education. It is concluded that strengthening coordination between notaries and registrars, together with technological integration and regulatory review, is essential to ensure correct registrations, prevent conflicts, and promote transparency in real estate transactions.
