Abstract

This research addresses the protection of the rights of older adults within the notarial service in Ecuador, highlighting the need for specialized attention in acts such as sales. Although the Constitution requires an optimal notarial service, the Notarial Law does not clearly define the criteria for differentiated attention, which represents a risk to the legal security of this vulnerable group. The study falls within the field of Notarial and Registry Law, applying a qualitative methodology based on documentary analysis and surveys. Among the legal findings, Constitutional Court ruling 832-20-JP/21 stands out, establishing reinforced obligations for notaries in this type of transaction. However, empirical evidence shows that these obligations are not adequately enforced in the canton of Babahoyo, where notaries consider the current regulations to be insufficient and point to a lack of training and specific regulations on the part of the Judicial Council.
