This essay analyzes, from the perspective of constitutional law and legislative theory, how subnational corruption in Peru, facilitated by the management of regional political movements, constitutes a direct violation of fundamental rights. Decentralization, intended to strengthen territorial democracy, has been co-opted by personalistic structures aimed at the rent-seeking capture of public budgets (Canon, Royalties). The embezzlement of funds in Regional Governments (GOREs), particularly through crimes such as collusion and peculation, directly translates into the denial of equitable and quality access to constitutionally guaranteed social rights, such as health, education, and sanitation. The paper proposes the need for a structural reform that strengthens the functional autonomy of the Comptroller General of the Republic (CGR) at the regional level and imposes rigorous ethical suitability filters, along with the power to cancel the legal status of movements that systematically defraud the State, in order to restore the legitimacy of the social pact and the fiduciary bond with citizenship.
